Once a purchase order has been made it is assumed that these terms and conditions have been accepted and you are happy to proceed. 

1. Introduction

Welcome to Latex Capital. By accessing or using this website, you agree to these Terms and Conditions. Please read them carefully before placing an order. If you do not agree, do not use our website. These Terms and Conditions apply to all products and services purchased through this website.

3. Order Acceptance

Orders are accepted once confirmed by Latex Capital. We reserve the right to refuse or cancel orders due to stock issues, payment verification, or suspected fraud.

4. Payment

  • Payment is accepted via major credit/debit cards.
  • Payment is taken at order placement unless otherwise agreed.
  • Deposits may be required for custom/made-to-measure items.

5. Pricing

Prices are listed in GBP. For EU customers, prices exclude VAT/customs duties unless stated otherwise.

6. Gift Cards

  • Valid for 12 months.
  • Cannot be exchanged for cash except where required by law.
  • Lost or stolen cards are the customer’s responsibility.

7. Subscriber Clause

By subscribing, you consent to receive marketing communications. You may unsubscribe at any time. Personal data is handled according to our Privacy Policy.

8. Production & Delivery

  • All garments are handmade to order; production times: 2–12 weeks.
  • Fast Track service is available for select items at an extra charge.
  • Delivery times:

    UK: 3–5 working days after production completion
    EU: 6–10 working days after production completion
  • Buyers are responsible for any customs/import duties.

9. Packaging

Discreet packaging is used for privacy: Polybag + tissue wrap + outer mailing bag.

10. Made-to-Measure & Hygiene

Hygiene Notice: All latex clothing is considered a hygiene-sensitive product. For health and safety reasons, worn or unsealed items **cannot be returned**, even if not custom-made.

  • Accuracy of measurements is the customer’s responsibility.
  • Custom or made-to-measure garments follow the same hygiene guidelines.

11. Returns & EU Withdrawal Rights

Non-Hygiene Items:

  • EU customers may cancel within 14 days of receiving the product.
  • Refunds will be processed within 14 days after receiving returned goods.
  • Buyer pays return shipping unless the item is faulty.

Custom / Hygiene Items: Cannot be canceled once production begins, except if defective or misdescribed.

Faulty Items: Notify issues promptly:

  • EU customers: within 14 days of delivery

Remedies include repair, replacement, or refund as required by law.

Order Cancellations: Accepted within 24 hours of purchase if production has not begun.

12. Limitations of Liability

Not liable for misuse, wear & tear, or minor variations due to handmade nature. Customers use products at their own risk.

13. Safety & Compliance

Keep Out of Reach of Children:

All products sold by Latex Capital are intended for adults aged 18 and over. Latex clothing may present risks, including choking, suffocation, or allergic reactions, if accessed or used by minors. By purchasing, you confirm that all items will be stored safely and kept out of reach of children. Latex Capital is not liable for any injury or damage resulting from use by individuals under 18.

Latex Clothing Safety:

- Do not purchase or wear if allergic to latex.

- Follow proper fit, comfort, and care guidelines.

- Keep away from open flames and high heat.

14. Intellectual Property

All content, designs, and images © Latex Capital. Unauthorized use is prohibited.

15. Force Majeure

Latex Capital is not liable for delays or non-fulfillment caused by events beyond our reasonable control, including strikes, natural disasters, or material shortages.

16. Governing Law

UK orders: governed by laws of England and Wales.

EU customers: local consumer protection laws apply.

17. Customer Acknowledgment

Placing an order constitutes agreement with these Terms & Conditions.
